Terms and conditions for the use of online resources and the Online shop follow. Terms and conditions applying to copying our materials can be found on this website under Reproduction of TC² materials.

TERMS OF USE OF ONLINE RESOURCES

  1. Tools for Thought, Source Docs, Critical Challenges and Inquiry-pacs are online resources developed by The Critical Thinking Consortium (TC²).

  2. Access/Authorized Users. Access to Tools for Thought, Source Docs and Critical Challenges is granted only to individuals who are employed by a Partner group or who have purchased an Individual membership. Access to Inquiry-pacs is granted only to individuals who have purchased a Inquiry-pacs license.

  3. Terms of Use Restrictions. Authorized users (see above) are entitled to access online resources on the TC² website to:

    1. Download one or more copies in hard copy form of the resource; such copies may not be sold and may not be distributed to anyone who is not an authorized user; and

    2. Download issues of the resource to hard disk or diskette, provided that such data is not made available to anyone who is not an authorized user. Authorized users who do download and/or print the resource must maintain all copyright and other notices.
      An authorized user may not make Tools for Thought, Source Docs, Critical Challenges or Inquiry-pacs available to anyone other than another authorized user, whether by telephone link or permitting access through his or her terminal or computer, or by other similar or dissimilar means or arrangements.
      Each authorized user will make reasonable efforts to maintain security and monitor all use (including unauthorized use) from its respective site.

  4. Terms and Fees. Upon payment of the partnership or membership fee and acceptance of these terms and conditions when creating a personal account, authorized users will have access to Tools for Thought, Source Docs and Critical Challenges until the annual partnership expires on June 30th (Partner employees) or for 12 months from the date of purchase of an Individual membership. Authorized users of Inquiry-pacs will have access for one year following the completion of the Inquiry-pacs program. Failure to renew a partnership/membership and pay the associated fees on or before the renewal date will cause the partnership/membership to be invalid. Individual Members may cancel their membership at any time provided written notice of their cancellation is given to the Consortium. Cancellation during the membership year will not entitle the Member to any fee rebate from the Consortium.

  5. Support. For all inquiries and tech support questions, please email mail@tc2 or call 604-639-6325 during business hours (Mon-Fri, 10am-5pm, PST). In addition, the Consortium encourages authorized users to engage in professional learning programs to support the use of the Tools for Thought, Source Docs, Critical Challenges and Inquiry-pacs materials.

  6. Copyright. Tools for Thought, Source Docs, Critical Challenges and Inquiry-pacs and their contents are subject to copyright protection and other rights of the publisher (The Critical Thinking Consortium), under the laws of Canada and the country of use.
    Authorized users acknowledge that they have no claim to ownership by reason of its use of or access to Tools for Thought, Source Docs, Critical Challenges or Inquiry-pacs. Downloading of resources is permitted solely for authorized user’s internal use to the same extent as the printed version of the resource. Recompiling, publication or republication of the materials, or any portion thereof, in any form or medium whatsoever, may only be done with specific written permission from The Critical Thinking Consortium.   7. Suspension or termination of access. The Critical Thinking Consortium reserves the right to suspend and/or terminate access to Tools for Thought, Source Docs, Critical Challenges or Inquiry-pacs for any authorized user without prior notice if an authorized user violates any term of this Agreement. Any use of Tools for Thought, Source Docs, Critical Challenges or Inquiry-pacs beyond the scope of the partnership/membership/license or any fraudulent, abusive, or otherwise illegal activities may be grounds for termination of access.

  8. Disclaimer of warranties.

    1. The Critical Thinking Consortium has made and will make good faith efforts to ensure that Tools for Thought, Source Docs, Critical Challenges or Inquiry-pacs are complete and accurate. However, TC² does not warrant completeness or accuracy, and does not warrant that authorized use of Tools for Thought, Source Docs, Critical Challenges or Inquiry-pacs will be useful or will satisfy the user’s requirements.

    2. The Critical Thinking Consortium warrants that it is entitled to grant the authorized use outlined in this Agreement, but makes no other warranties or representations of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

    3. Authorized users will be permitted to access Tools for Thought, Source Docs, Critical Challenges or Inquiry-pacs at any time. The Critical Thinking Consortium will not be liable for any delay, down time, or other failure of the online access, but will use reasonable efforts to correct any online access problems brought to its attention.

    4. The Critical Thinking Consortium will not be responsible for incidental, consequential, or any other damages arising out of or in connection with the service or materials provided hereunder.

    5. Each authorized user assumes the responsibility for all use of the Tools for Thought, Source Docs, Critical Challenges or Inquiry-pacs resources and agrees to indemnify and hold TC² harmless from any liability or claim of any person arising from such use.

  9. General

    1. This Agreement constitutes the entire agreement of the parties and supersedes any prior arrangements and understandings relating to the subject matter hereof. Only a written instrument signed by both parties may amend it.

    2. The authorized user may not assign or transfer any rights under this Agreement. However, schools or districts that purchase Inquiry-pacs licenses on behalf of their teachers may request the transfer of a license when an original licensed user is no longer teaching the course or grade for which the license was purchased or moves away from the school or district. Licenses transferred to a new user will continue for the remainder of the original license period, apply to the same materials and be eligible for renewal as per the terms of the original agreement. TC2 charges a $25.00 administration fee to transfer an Inquiry-pacs license license to a new user.

    3. In the event that any provision of this Agreement is held to be invalid, the remainder of the provisions shall continue in full force and effect.

    4. This Agreement will be governed and construed according to Canadian Law. Any action arising out of or relating to this Agreement or Tools for Thought, Source Docs, Critical Challenges or Inquiry-pacs may be brought in courts situated in Canada, and the parties consent to the jurisdiction of such courts.

TERMS OF USE OF THE ONLINE SHOP
This Statement outlines the terms and conditions governing all sales and purchases made through this website, regardless of whether the order was transmitted via the internet, telephone or post. By accessing, browsing and/or using this website you acknowledge that you have read, understood and agree to be bound by these terms and to comply with all applicable laws and regulations. If you do not agree with these terms, do not use this site.

  1. Pricing

    All prices quoted are subject to change at any time at the discretion of The Critical Thinking Consortium (TC²). All prices are quoted in Canada dollars (CAD, $). TC² reserves the right to reject any orders which include incorrect prices which may occur due to data entry errors, code errors, hacking, incorrect pricing provided by manufacturer, translation errors etc. Prices are not negotiable and do not include postage and handling. Postage and handling costs will be calculated when completing the order.

  2. Payment

    Payment options provided by the TC² Online shop include Visa, MasterCard, and PayPal accounts. All payments are processed through the PayPal system, even if you do not have PayPal account. If you encounter any problems with PayPal, please contact our office. Purchase orders and payments by cheque may be arranged by contacting our office:

  3. Returns policy

    If an order has been dispatched by courier and is not received or if an item is received and it is either damaged or faulty, a return claim MUST be filed with TC² within 7-14 days from date the goods are received. Email details of your claim to mail@tc2.ca. The following options will then be made available:

    1. Replacement: If possible, a replacement will be sent, subject to availability.

    2. Credit: If no replacement is available, a credit will be offered to the full amount of the purchase price.

      If a refund is required, it will be provided according to the original payment (e.g., if payment was made on Visa, the Visa account will be credited via PayPal). Returns are not accepted due to a change of mind, so please choose carefully. Exchanges will not be permitted. Sales of online resources and digital publications are final.

  4. Site access

    Access to the TC² Online shop website is granted only for the purpose of accessing the products offered. Under no circumstances may any individual alter any part of the website. No part of this site may be reproduced for any reason, nor may any parts of the site be displayed anywhere apart from the TC² Online shop at www.shop.tc2.ca unless written permission has been granted by TC². You are granted access to the TC² Online shop website under the condition that you will not interfere, or attempt to interfere with any of the content.

  5. Limitation of Liability

    UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL TC² BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE. IF YOUR USE OF MATERIALS FROM THIS SITE RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ANY COSTS THEREOF.

  6. Law and Jurisdiction

    These Terms and any matter relating to this Site will be governed by Canada law and the Canada courts shall have non-exclusive jurisdiction in respect of them.

  7. Privacy

    We are committed to protecting your privacy and this statement summarises what personal details we may collect from you before, during or after you use our Site and what we will do with them. Any changes to our privacy policy will be posted on this page.

    When you contact us we will use your email address for the purposes of administering your query or order and responding to you. We will not publish your personal information and will not supply your personally identifying information to other companies or individuals. We may, with your permission, send you information about our company and our products and services.

  8. Security

    All of our credit card transactions online are processed by PayPal, so shopping at the TC² Online shop is secure. Please refer to the PayPal site for detailed security information.

  9. Copyright

    All content and the compilation of all content on the TC² Online shop site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, artworks, products and data compilations is the property of The Critical Thinking Consortium (TC²) and protected by Canada and International copyright laws. No part of the TC² Online shop website may be reproduced without the express, written permission of The Critical Thinking Consortium (TC²).
